Election Commission has said that a dual national cannot hold a rank in party and there are clear laws have been given in Political Parties Act-2002, over this issue,
The ECP conducted hearing over a plea against dual nationality of Tahir-ul-Qadri on Monday. Engineer Jamil Malik, the petitioner, has argued in his application that a dual national cannot hold any post in party then in what capacity Tahir-ul-Qadri signed a deal in Islamabad Long March.
Member Election Commission (Punjab), Justice (r) Riaz Kayani said in his remarks during hearing that clear laws are given in Political Parties Act-2002 and it is clearly written in the Constitution that who is not eligible of being a member of the Parliament, he cannot keep any party rank as well.
The counsel for Pakistan Awami Tehrik (PAT) stated that Tahir-ul-Qadri has quit the party position and now he is Chairman of Minhaj-ul-Quran not the PAT; the Election Commission has been also informed that he has quit the party rank.
The ECP instructed the petitioner to withdraw his application against Tahir-ul-Qadri as he has left position in the PAT.Engineer Jamil Malik of the Communist Party, the petitioner, agreed upon the ECP instruction and withdrawn his application against Dr. Tahir-ul-Qadri.
