Balochistan Governor Nawab Zulfiqar Ali Magsi on Monday dissolved the Balochistan Assembly on the advice of Chief Minister Aslam Raisani.
A notification issued in this regard said Chief Minister Aslam Raisani, using his powers under Article 112 (1) of the Constitution, sent an advice to the Balochistan governor for dissolution of the provincial assembly.Following the advice sent by the CM, Nawab Zulfiqar Magsi issued a notification dissolving the Balochistan Assembly on Monday. The Balochistan Assembly’s tenure was to be completed on April 6 this year, but the decision for its dissolution came after the four provincial CMs met and agreed unanimously to dissolve the provincial assemblies before or on March 19.
However, the caretaker setup still remains a dilemma in the constitutional corridors of Balochistan and Aslam Raisani would remain the chief minister of Balochistan till the appointment of a caretaker chief minister in the province.Meanwhile, the Balochistan High Court (BHC) on Monday annulled the notification issued by Speaker Matiullah Agha nominating JUI-F leader Maulana Abdul Wasay as the opposition leader in the Balochistan Assembly.
Allowing Nawabzada Tariq Magsi to continue as the opposition leader, the BHC summoned the deputy attorney general and the advocate general on Tuesday (today).The BHC division bench, comprising Chief Justice Qazi Faez Essa and Justice Naeem Akthar, issued these directions while hearing a constitutional petition filed by Opposition Leader in Balochistan Assembly Nawabzada Tariq Magsi.
The petitioner pleaded in the application that Maulana Abdul Wasay has served as the senior provincial minister for the last five years and now when the phase of forming an interim government came, Speaker Matiullah Agha nominated him as the opposition leader while his resignation has not so far been approved.
The court revoked the notification of Matiullah Agha appointing Maulana Abdul Wasay and directed Tariq Magsi to continue his work. The court also summoned the deputy attorney general and the advocate general on today (Tuesday) for further hearing.
